Cloud to return to court Monday

Turkey Creek’s mayoral seat is still up in the air after the Third Circuit Court of Appeal reversed the decision of the district court on Heather Cloud’s lawsuit, in which she claimed her opponent, Bert Campbell, with the assistance of Stanley Leger, offered money and favors for votes in the November 4, election. Campbell won the election with 110 votes versus Cloud’s 106 votes.
The opinion of the appeal court states, “Finding that the trial court erred in granting the exception, we reverse the judgment and remand for further proceedings.”
The appeal court stated that the trial court incorrectly granted an exception to Campbell. The trial court originally granted the exception because there was no “cause of action” set in Cloud’s suit. However, the appellate court disagreed, stating Cloud very clearly set out a “cause of action” in which the votes in question would be removed from Campbell’s total and added to Cloud’s, thereby making her the winner of the election.
The suit is expected to return to trial court here in Evangeline Parish Monday, November 24.
